Construction is the deadliest industry when it comes to heat-related illness. From 1992 through 2022, 334 construction workers died from heat exposure. 34% of all heat-related occupational deaths across every industry combined, despite construction representing a much smaller share of the overall workforce. The work is physically demanding, largely outdoor, and often cannot be moved to cooler hours. That is not going to change. What can change is how subcontractors and crews manage the risk.
The regulatory environment is tightening. OSHA’s Heat National Emphasis Program was renewed in April 2026 for a five-year period and is now actively targeting construction, agriculture, manufacturing, and warehousing for enforcement. Nevada, Maryland, and California have all enacted enforceable state heat standards. A federal heat illness prevention standard is in rulemaking and expected to apply specific trigger thresholds and written plan requirements once finalized. Serious OSHA violations carry a maximum penalty of $16,550 per violation in 2026, with repeat or willful violations reaching $165,514. Getting ahead of this now is significantly less expensive than responding to a citation or a fatality.
Why the First Days Are the Highest Risk
One of the most important (and most overlooked) facts about heat illness is when it typically strikes. OSHA data shows that 50% to 70% of all outdoor heat fatalities occur during the first few days of working in a hot environment. The body has not yet developed the physiological tolerance needed to work safely in the heat. Workers who are new to a site, returning from time off, or suddenly exposed to a heat wave are all at elevated risk, even experienced tradespeople who have worked hot jobsites before.
This makes acclimatization one of the most critical protocols on any warm-weather construction site. A structured acclimatization plan gradually increases heat exposure over seven to fourteen days for new or returning workers, reducing the risk of heat stroke and heat exhaustion significantly during the highest-risk window.
The Three Types of Heat Illness and What They Look Like
Heat stroke is the most serious and life-threatening form. The body loses the ability to regulate temperature. Warning signs include hot, dry skin, confusion, slurred speech, and loss of consciousness. Heat stroke is a medical emergency requiring immediate cooling and 911.
Heat exhaustion occurs when the body loses fluid and electrolytes faster than they are replaced. Symptoms include pale or clammy skin, heavy sweating, nausea, vomiting, muscle cramps, and headache. Remove the worker from heat immediately, provide fluids, and monitor closely. Left untreated, heat exhaustion can progress to heat stroke.
Heat cramps are caused by excessive sweating that depletes salt and fluid. They typically appear in the legs, arms, or abdomen and serve as an early warning that a worker needs rest, fluids, and shade before symptoms escalate.
All three conditions are preventable. All three are also recognizable before they become emergencies, which is why supervisor awareness and crew monitoring are non-negotiable on hot-weather builds.
What the Proposed Federal Standard Requires
The OSHA proposed rule on heat illness prevention, currently in rulemaking, establishes two temperature trigger thresholds with specific employer obligations at each level.
At 80 degrees Fahrenheit: Employers must provide access to water, shade, and cooling. Rest breaks must be available.
At 90 degrees Fahrenheit: Stricter controls apply. Paid 15-minute rest breaks are required every two hours. Supervisors must actively monitor workers for symptoms of heat illness.
Even without a final federal rule, OSHA is already enforcing under the General Duty Clause, which requires employers to provide a workplace free of recognized serious hazards. Heat is a recognized serious hazard in construction. The five-year NEP renewal means inspectors are actively looking for it.
States with their own standards—California, Nevada, and Maryland—have additional requirements that apply regardless of where the federal rule lands. If you work in those markets, know the state-specific obligations.
Practical Protocols for Skilled Trades Supervisors
The following practices reflect both current OSHA guidance and the proposed rule’s requirements. Implementing them now protects your crew and positions your business for compliance when the federal standard is finalized.
Water. Provide cool drinking water at the worksite and encourage workers to drink at least one cup every 20 minutes. Do not rely on workers to self-regulate hydration. Make it easy and expected.
Shade and rest. Provide designated shaded rest areas accessible throughout the workday. Build rest breaks into the schedule explicitly, especially during the hottest hours of the day (typically 10 a.m. to 4 p.m.).
Acclimatization. New workers and those returning from leave should follow a structured ramp-up schedule. Start with lighter duties or shorter exposure in the heat and build up over the first two weeks.
Monitoring. Assign supervisors to actively watch for signs of heat illness, not just respond when workers report symptoms. Workers experiencing heat exhaustion or approaching heat stroke often do not recognize it themselves.
Written plan. Under the proposed OSHA rule, employers in high-hazard industries will be required to maintain a site-specific written heat illness prevention plan that designates a Heat Safety Coordinator. Getting that documentation in place now, before enforcement begins, is a straightforward step.
PPE. Reflective and breathable fabrics, cooling vests, and wide-brim hard hats all reduce heat load on workers in direct sun. A 2025 OSHA amendment now requires that PPE provided to construction workers must properly fit each individual employee, a standard that applies to heat-related PPE as well.
Staffing Levels Matter for Heat Safety
One of the less obvious heat safety risks on skilled trades jobsites is understaffing. When crews are running lean, there is less ability to rotate workers out of heat exposure, cover for someone who needs a break, or respond quickly when a worker shows symptoms.
